That application Z.1714.26, submitted by 445312 Ontario Limited, be refused for the following reasons: The proposed zoning by-law amendment application for a 13 unit apartment building does not respect the three storey height limit that was passed by Council as part of OPA 248 in 2005. The residential designation, 13 unit and three storey height limit contained in OPA 248 was passed to reflect what was approved in the zoning by-law back in 1998 and to guide infill development on this site to provide a desirable transition between the Central Business District to the north and the Low Density Residential to the south. The setbacks, height and massing of the proposed building are not compatible with the surrounding area, nor is it compatible with the streetscape along Navy Street and Robinson Street. (continued) The site directly abuts the Old Oakville Conservation District however the proposal does not properly preserve, maintain or enhance the character of the Heritage Conservation District as contemplated by the Official Plan. The proposed setback and heights create undesirable precedents which are not in keeping with the character of the surrounding area. 2. That the Planning Services reports dated January 19, 2010 and October 27, 2009, related to this application be received as information.
