Planning and Development Council

That this meeting proceed into a Committee of the Whole session.

That the Director of Planning Services be authorized to grant a one year extension to the Draft Plan of Subdivision (24T92005/O) submitted by Silwell Development Limited.

That the Subdivision Agreement between the Town and Fernbrook Homes (Bronte 15) be approved and the Town Solicitor be authorized to make minor changes to the Agreement, which do not affect the substance of the Agreement; and 2. That the Mayor and Clerk be authorized to execute the Subdivision Agreement with Fernbrook Homes (Bronte 15).

That comments from the public with respect to the Official Plan Amendment, Zoning By-law Amendment and Draft Plan of Subdivision applications by Upper Middle Road GP (Files: Z.1506.12 & 24T-12002/1506), be received.

That Planning Services department report PD-050-13 be received; and 2. That Zoning By-law Amendment 2013-048, which makes general amendments to the North Oakville Zoning By-law 2009-189, be passed.

That the Temporary Use By-law Extension application (File No. Z.1312.07) submitted by 1463083 Ontario Limited be approved and that By-law 2013-053 to permit the lands to be used as a golf driving range as a temporary use for a period of three years be passed.

That the report PD-044-13 dated May 17, 2013, be received; and 2. That staff be directed to continue to develop options to reflect conditions as the studies unfold and the consultation with the public continues.

That a notice of intention to designate be issued for the property at 273 Burnhamthorpe Road East.

That staff be directed to develop program details for a heritage grant program as outlined in the “Heritage Incentives” report from Planning Services, dated May 29, 2013; and 2. That the financing and implementation for the heritage grant program be considered through the town’s budget review process.

That Council have regard to the criteria described in the report of the Legal department, dated May 17, 2013, in determining when Town staff should attend Ontario Municipal Board appeals of Committee of Adjustment decisions, or when decisions of the Committee of Adjustment should be appealed by the Town.

That the following recommendation pertaining to Items 6a and 6b of the Heritage Oakville Advisory Committee minutes from its meeting on May 28, 2013, be approved and the remainder of the minutes be received: 6a. Heritage Permit Application HP027/13-42.20T 133-135 Thomas Street - New Three-Storey Mixed-Use Building - Report from Planning Services Department, May 14, 2013 1. That Heritage Permit Application HP027/13-42.20T for a new three-storey mixed-use building at 133-135 Thomas Street, as attached in Appendix A to the report dated May 14, 2013, from Planning Services, be approved; and 2. That this heritage permit expire two years from the date of final approval by Council. 6b. Heritage Permit Application HP029/13-42.20W 273 William Street - Relocation and Restoration of Garage and Construction of a New Garage Addition - Report from Planning Services Department, May 14, 2013 1. That Heritage Permit Application HP029/13-42.20W for the relocation and restoration of the existing garage and the construction of a new garage addition at 273 William Street, as attached in Appendix A to the report dated May 14, 2013, from Planning Services, be approved; and 2. That this heritage permit expire two years from the date of final approval by Council.

That, in the matter of the appeal to the Ontario Municipal Board by Accu Servo Technology Inc. respecting the west side of Ninth Line north of Upper Middle Road (OMB File Numbers PL130412), the Committee of Adjustment decision be upheld and the Town Solicitor be directed to advance this position before the Ontario Municipal Board.

That the Town Solicitor be instructed to take no position in the appeals by Karen Jensen and John Krawczyk before the Ontario Municipal Board (PL130453), regarding a minor variance requests for 2092 Water’s Edge Drive (CAV A/039/2013).

That this committee rise and report.

That the report and recommendations of the Committee of the Whole be approved.

That the following by-law(s) be passed: 2013-041 A by-law to declare that certain land is not subject to part lot control – (Part of Block 115, Plan 20M-1086, Fox Farm Developments Inc.). 2013-048 A by-law to amend the Town of Oakville’s North Oakville Comprehensive Zoning By-law 2009-189, as amended, to make a number of housekeeping amendments. (Re: Item 4) 2013-053 A by-law to amend the Town of Oakville's North Oakville Zoning By-law 2009-189, as amended, to permit a golf driving range and associated uses as temporary uses for a period of three years on the lands known as 340 Burnhamthorpe Road East, Part Lot 12, Concession 1, N.D.S. (Vic Hadfield Golf & Learning Centre). (Re: Item 5) 2013-058 A by-law to confirm the proceedings of a meeting of Council.
